Submission to the Honourable Paul Scully, Minister for Planning & Public Spaces.

I join with others and kindly request you to URGENTLY revoke the decision to approve a housing development at the ‘Wallum’ site situated at 15 Torakina Road Brunswick Heads (DA 2021/575). in regards to the development of “Wallum” (15 Torakina Rd, Brunswick Heads NSW, 2483 ... SEE https://thewallum.blogspot.com/p/the-site.html),

The bulldozers' arrival is imminent as alarmingly Byron Council have contentiously approved a construction certificate on 8 February 2024. 

Since your department was the consent authority for this development through the NRPP in May 2023 and previously in 2013 as a concept plan, your department has the authority and power to revoke what has turned out to be such a poor planning decision. Now that it is increasingly apparent that your department was not in possession of all the germane facts it is important that you now take remedial action. 

The proponent will be in breach of matters of national environmental significance and will be reported accordingly if you allow this unsustainable housing development to occur on culturally significant Aboriginal land and in a place where nationally threatened species and habitats exist. 

I unequivocally support the local community in its strong opposition to this ‘Zombie DA’ and request you revoke the decision, and rezone the wallum site as environmental conservation site or refer the matter to the Federal Environment Minister for assessment under the EPBC Act. 

In support of the local activists, I will not stop my protestation until this pristine biodiverse coastal swamp heathland with Aboriginal significance along with numerous threatened species habitats is protected from inappropriate development and environmental degradation.
